In the Czech republic is site (http://www.pandora.cz) which is runnig
listserv called mailman and the autor have never heard about "our" 
mailman. But theyr mailman is not free software and it is not avalaible
for any other. So it is not confusion.

You cannot make some name unavalaible for other as long is the name widely
known, as Linux or so.
