This is an HTML/MIME problem. It is addressed better in the 2.1.x series
(which you are running), but apparently not well enough for your
purposes. Others on the list have more experience with that than I do.

The footer should appear fine on Text based email messages that folks
send to the list, but HTML based emails will have problems with the
footer.  The footer will be included, but may not be displayed.

If you have any interesting info that you really need to appear in every
message, you might consider switching that info to the header.
The other alternative is simply to create a monthly message with list
information/etiquette and send that out via a cron-job.
