That's because:

>>> 'C:\\dir'.split('\\')
['C:', 'dir']
>>> 'C:\\'.split('\\')
['C:', '']

So you could write instead something like

    x1 = path1.rstrip(os.sep).split(os.sep)
    x2 = path2.rstrip(os.sep).split(os.sep)

in your function
