Yes -- it would be rather useless if you could never create a list
wouldn't it?

In the current version it is command line based.  Depending on your
choice of local MTA, it may or may not requite root access.  In the
next version of Mailman there is a web interface to list creation,
which again, is somewhat subject to your MTA choice and
configuration.
